Abstract

This article deals with the comparative exposure of the doctrinal and jurisprudential concept regarding the so-called Fake News.Initially, the issue of the most appropriate terminology to describe the phenomenon of Fake News or the use of the term disinformation is studied. The essential characters for the doctrine are discussed, in search of a formulation of a concept about the notion of what Fake News is.This work ends, demonstrating, through precedents from the Federal Supreme Court, how the Judiciary has been dealing with the phenomenon and what notion judicial decisions bring about the researched concept.
