AN EFFECTIVE MEASURE FOR COMPLIANCE WITH THE BRAZILIAN LEGAL SYSTEM

Abstract

The research analyzes the feasibility of suspending social media platforms in order to ensure compliance with the Federal Constitution and Brazilian legislation by companies that provide virtual platforms, such as WhatsApp, X (formerly Twitter), and Telegram. The study aims to demonstrate that such a measure may constitute a legitimate instrument for the affirmation of national sovereignty. The deductive method is adopted, based on bibliographic research, documentary analysis of legislation, and examination of decisions of the Supreme Federal Court (STF). It is concluded that, although an extreme measure, the suspension of social media platforms may act as a coercive mechanism to guarantee compliance with national law and, in this way, give effect to one of the foundations of the Federative Republic of Brazil, as provided in Article 1, item I, of the Federal Constitution.
