This article approaches the Democratic State under the rule of Law, from the historical context of its emergence to the current conception, which has as its mainstay, in addition to the established legality, isonomy and participation, the dignity of the human person. In this aspect, it is verified that there is no talk of human dignity without sustainability, since the human being and the environment are inseparable. In comparison with the unprecedented environmental crisis experienced, there is a need to guarantee the Democratic State under the rule of Law, which is only achieved with the implementation of sustainability, given the insufficiency of other concepts such as sustainable development.
