THE FUNDAMENTAL DUTY TO PRESERVE THE ENVIRONMENT FROM ROGER SCRUTON’S PERSPECTIVE

Abstract

This study is a bibliographic research carried out under the inductive method, which has proposed to investigate the fundamental duty of environmental preservation from the perspective of Roger Scruton. It is based on the current discussions about environment, which involves everything from climate change to the depletion of natural resources. The study asks how it is possible to understand the fundamental duty of preserving the environment, as provided in the Constitution, related with Roger Scruton’s philosophical perspective. Therefore, the first part of the study addresses the fundamental duty to maintain an ecologically balanced environment. In the second part, the study presents some of Roger Scruton’ main ideas about environmental preservation. From this, it was possible to observe that the fundamental duty to preserve the environment can be conceived, from Scruton’s perspective, through an individual responsibility, motivated by the feeling of love for the home, the place where welives. This feeling constrains people to act positively for environmental conservation.
