Abstract

This article aims, at first, to present the inconsistency of public policies regarding the realization of social rights, related to the adequate performance of the Social Function of the Family. Based on the criticism of the current economic model and the so-called consumer society, the article also addresses the important role of the Judiciary in achieving social rights towards the convergence of a sustainable planet. It is concluded, in the end, that the Social Function of the Family must be strengthened by the State, understanding that its absence will result in the accumulation of competences not exercised by the family entity and, consequently, in the increase of public resources channeled to solve socio-environmental problems that they are arising. The Judiciary must realize this social function, through proactive action, implementing public policies to implement social rights that are denied by the State, such as access to health, housing, decent living conditions and education. As for the Methodology, the inductive method and the qualitative research were used. Referring Techniques, Category, Operational Concepts and Bibliographic Research were used.
