Abstract

This article brings reflections on the exercise of Jurisdiction in a context of Access to Justice, Judicialization and the currently existing qualitative and quantitative challenges. To this end, an overview of the current scenario is providedand, subsequently, aspects of the exercise of the Jurisdiction are articulated with new factors such as the crisis of Positivism, the application of constitutional rules and principles, Judicial Activism and Self-restraint and the functions of the judges. The objective is to expose, with scientific humility, guidelines that prioritize technical, judicious and thoughtful performance by judges in the democratic environment, within the old idea of balance.
