Abstract

This article intends to analyze the authorship by the control over the organization in the Project of New Criminal Code and the possibility of its use for the criminal responsibility of the high corporate level. First, it will be addressed the theoretical aspects of this modality of mediated authorship and the requirements for its application based Claus Roxin's fact control theory. Then, it will be explained the theoretical positions regarding its application to corporate crime. Finally, it will be analyzed the way in which mediated authorship by the control of the organization was proposed in the New Criminal Code Project and the penal repercussions that result from it for the high corporate level.
