Abstract

This scientific article addresses Topic 1,087 of the Brazilian Supreme Federal Court (STF). It aims to understand the reasons behind the formulation of the respective thesis. Following a brief overview of the principle of the sovereignty of jury verdicts in Brazil, the individual votes of the Justices will be examined, highlighting the reasoning that led to the establishment of the thesis. The analysis reveals the existence of two opposing currents within the Court’s deliberations. In conclusion, the article outlines the specific reasons that led to the prevailing understanding: the annulment of an acquittal is constitutional in cases of manifest contradiction with the evidence in the case records, when such acquittal is incompatible with the circumstances of the case, the binding precedents of the STF, and the Federal Constitution. The methodology adopted for this research is bibliographic and documentary, as doctrinal sources will be employed to construct the principled framework, along with an analysis of the Brazilian Supreme Federal Court’s decision. The selected method is analytical, the research is qualitative, and the analysis will be limited to the judgment rendered in “ARE 1225185/MG”, which addressed Theme 1.087.
