Abstract

With the implementation of custody hearings, a critical reflection on their effectiveness in forensic practice becomes necessary. Although conceived as an instrument to protect the fundamental rights of the person arrested, its implementation has revealed structural limits in the face of a penal system guided by a punitive legal culture, which still credits prison with the legitimate function of punishment as a response to combating crime.
