SOCIAL AND LEGAL ASPECTS OF THE REAL RIGHT OF SLAB

Abstract

The present study deals with the actual law recently introduced in the slab Brazilian legal system as a public policy for land regularization. In this sense initially makes an analysis about the fundamental rights of man, a constitutional study of matter, focused primarily to the fundamental right of residence. Then comes the real rights brought by law in Article 1225 of the Civil Code. It gives emphasis on ownership and other real rights that have a similar character to the right of exthe slab. Finally, it is a specific approach on the real right of slab, especially since now the difficulty in treating the topic given the scarcity of references in its respect. Regarding the techniques employed for the production of scientific work, it is the use of the technique of bibliographic search on through the doctrinal and jurisprudential. The end notes that the real right of slab is a real right of superelevation in which the property owner assigns the surface of your slab to others giving this the allocation of housing for themselves and their families.
