Abstract

This article addresses denial of blood transfusion by Jehovah’s Witness patients and conflicts of fundamental rights. For a better understanding of the subject, we address fundamental rights, such as the right to life, the right to liberty and freedom of religion, all from the principle of the dignity of the human person, considered as a basic principle, as well as the beliefs of the Witnesses of Jehovah who justify the refusal of the blood procedure. This work used the method qualitative descriptive, through bibliographical research, examination of books and articles. Thus, this article seeks to demonstrate that, in fact, the conflict of rights can be solved by weighing fundamental rights based on constitutional principle and analysis of the concrete case.
